Acceptance of Terms

By downloading, installing, or using the Balanced Life mobile application ("App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

Description of Service

Balanced Life is a fitness and wellness tracking application that provides:

  • Weight, food, and measurement tracking
  • Habit building and goal setting
  • AI-powered workout and meal planning (Premium)
  • Progress analytics and predictions (Premium)
  • Community features and leaderboards (Premium)
  • HealthKit integration (Premium)

IMPORTANT: Balanced Life is NOT a medical device and does NOT provide medical advice.

  • The App is for informational and tracking purposes only
  • Always consult with a qualified healthcare provider before starting any diet or exercise program
  • Do not disregard professional medical advice or delay seeking it because of information from this App
  • If you have a medical condition, consult your doctor before using this App
  • BMI, TDEE, and other calculations are estimates based on general formulas
  • AI-generated meal plans and workout suggestions are not medical prescriptions

User Accounts

Account Creation

  • You may use the App with or without creating an account
  • If you sign in with Apple, you agree to Apple's terms of service
  • You are responsible for maintaining the confidentiality of your account
  • You must be at least 13 years old to use this App

Account Security

  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized access
  • We are not liable for losses due to unauthorized use of your account

Subscription and Payments

Free Tier

The free version includes basic tracking features at no cost.

Premium Subscription

  • 3-Day Free Trial: New users can try Premium free for 3 days
  • Monthly Plan: $39.99 CAD per month
  • Annual Plan: $329.99 CAD per year
  • Pricing displayed in your local currency; billed in CAD
  • Subscriptions auto-renew unless canceled at least 24 hours before the period ends
  • Manage or cancel subscriptions in your Apple ID account settings
  • No refunds for partial subscription periods

Payment Processing

  • All payments are processed through Apple In-App Purchase
  • Subject to Apple's terms and conditions
  • Prices subject to change with notice

User Content and Data

Your Data

  • You retain ownership of all data you input into the App
  • Most data is stored locally on your device
  • Community usernames and scores are stored in the cloud
  • You grant us license to use your data to provide App services

Community Guidelines

When participating in community features, you agree NOT to:

  • Use offensive, inappropriate, or misleading usernames
  • Harass, bully, or intimidate other users
  • Share false or misleading information
  • Attempt to manipulate leaderboards or scores
  • Violate any laws or regulations

AI Features

  • AI-generated content is provided "as is" without guarantees
  • AI suggestions should not replace professional medical or nutritional advice
  • You must consent to data sharing before using AI features
  • We are not responsible for actions taken based on AI recommendations

Prohibited Uses

You agree NOT to:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to access the App
  • Interfere with other users' use of the App
  • Copy, modify, or distribute the App without permission
  • Remove or alter any copyright notices

Intellectual Property

  • The App, including all content, features, and functionality, is owned by Balanced Life
  • Protected by copyright, trademark, and other intellectual property laws
  • The Balanced Life name, logo, and book content are our trademarks
  • You may not use our trademarks without written permission

Third-Party Services

  • The App integrates with Apple HealthKit, Firebase, and Anthropic AI
  • These services have their own terms and privacy policies
  • We are not responsible for third-party service performance or availability
  • Your use of third-party services is at your own risk

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The App is provided "AS IS" without warranties of any kind
  • We do not guarantee the App will be error-free or uninterrupted
  • We are not liable for any health outcomes related to App use
  • We are not liable for data loss, even if stored locally
  • Our total liability shall not exceed the amount you paid for the App
  • We are not liable for indirect, incidental, or consequential damages

Indemnification

You agree to indemnify and hold harmless Balanced Life from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another user

Termination

  • You may stop using the App at any time
  • We may suspend or terminate your access for violations of these Terms
  • Upon termination, your right to use the App ceases immediately
  • Sections that should survive termination will remain in effect

Changes to Terms

  • We may modify these Terms at any time
  • Continued use of the App after changes constitutes acceptance
  • Material changes will be communicated through the App or email

Governing Law

These Terms are governed by the laws of Alberta, Canada, without regard to conflict of law provisions.

Dispute Resolution

  • Any disputes shall be resolved through binding arbitration in Alberta, Canada
  • You waive the right to participate in class actions
  • Small claims court is an alternative for qualifying disputes

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
